Dear Sir/Madam:  

My firm represents the employee Class Plaintiff (“Percy”) regarding the above lawsuit against certain  entities identified as class defendants in complaints on the enclosed USB drive. You are named because  Percy demonstrated to you, last year, an alternative employment practice and benefits of paid on-the-job  apprentice training and related classroom instruction, enforced by 42 U.S.C. 2000e-2 of the Civil Rights  Act, addressing the need for affirmative action to and including the Percy Classes’ families, significantly  disadvantaged in employment opportunity, wanting to compete for jobs and careers based on skills. You  were asked in good faith that if you believed that xxxxxxxxx has been identified in error  or had questions, to reach us by phone or email. You were not persuaded per the provisions of 42 USC  §2000e-2(k)(l)(A)(ii) and §2000e-2(k)(l)(C) of the Civil Rights Act, and definitions at 42 U.S.C. §2000d,  and we are proceeding herewith. I enclose a form waiver of service of the summons in the lawsuit in which  you have been named with instructions in accordance with Federal Rules of Civil Procedure 4( d).  

The complaints, summons with rider and other documents relative to Waiver of Service of Process and a  Motion to Federal Multi-District Litigation Panel (MDLP) are on the enclosed USB Drive.  

This is not formal service of summons or notification from the court, but rather my request that you sign  and return the enclosed waiver of service to avoid service of the judicial summons. I enclose a stamped  and addressed envelope for your use. An extra copy of the waiver is also enclosed for your records. If you  comply with this request and return the signed waiver, it will be filed with the court and no summons will  be served on you. You may also email me at jkeman@kemanllp.com.  Once again, in good faith, I am certainly amenable to discussing the nature of the complaint to resolve  this with you.
